What is Divorce?
Divorce is the official ending of a marriage. When the divorce becomes final you are free to marry again. A divorce some time include issues such as division of marital property, splitting retirement plans (IRA), determining spousal support and the issues of parenting time, child custody and child support. A Michigan divorce case begins when either a husband or wife files a “Complaint for Divorce” with the Circuit Court in the county where at least one party resides.
The law in Michigan allows couples to seek a divorce without any reasons or grounds. The only thing you need to say that there are irreconcilable differences that exist that prevent the marriage from continuing.

Where?
The first decision you need to make is where to file your divorce.
Michigan law requires that you have lived in the State of Michigan for six months and the county where you file for ten days.
The Divorce Process
Almost every family law case starts with a document called a complaint. In Michigan, filing a “Complaint” begins the divorce lawsuit process. The person who files for divorce first is Plaintiff. Michigan requires that certain information be disclosed in a Complaint for Divorce. One must simply state that the marriage has been broken down to the extent that all the objects of matrimony have been destroyed. After the Complaint is filed, the county Clerk of Court issues a Summons. For a lawsuit to begin, both the Complaint and Summons must be served on the other spouse. Certain requirements for service must be met or the divorce may not being granted. Generally, you need to serve your spouse with complaint. The next step in the legal process is the Answer to the Complaint and or if you wish to file a Counter-complaint.
Discovery in Michigan Divorce Law
If the parties don’t immediately begin settlement negotiations, the next phase of the lawsuit is
called discovery. “Discovery” is a legal mechanism designed for gathering information about either party to the divorce. During discovery you have four methods that are used to gain information from the other party before going to divorce court. Discovery ultimately is a process of information gathering. The deeper you dig, the more information you get about the pertinent issues in your case.
Many people who try to handle their own divorce wind up having their documents rejected by the court because they were not drafted properly or the proper procedures were not followed.
