Michigan No-Fault Divorce Law 
Michigan is a no-fault divorce state, meaning neither spouse is blamed for the breakup. No-fault lessens the potential damage to all parties caused by the process of divorce. If the marriage is "irretrievably broken", meaning there is no way to save the marriage, then that is all that is required to obtain a divorce. Either spouse can file for the divorce.

However, there are three things that need to be proven in order to obtain a divorce in Michigan:

The marriage is valid
One party has been a Michigan resident for six months
The marriage is definitely broken

However, no fault divorce does not mean that spouse conduct such as adultery, assault, abuse, cruelty or another “wrongful” act is not relevant.  Although conduct does not need to be proven to actually get the divorce in Michigan, misconduct can have a bearing on all aspects of the case.  For example, conduct can affect how the court divides the martial property of the parties, awards spousal support, awards attorney’s fees, awards custody, parenting time, and to some extent child support. Although there is usually a preference for joint custody and equal property division, “no fault” does not mean that that will be the case, and “no-fault” does not mean that everything will end up equal.  The court in Michigan has to look at other standards for each particular issue in the case such as child support case, and will make orders accordingly as to those issues. By not focusing on who is to blame, the parties’ financial and emotional resources may be utilized to address the legal issues at hand.
